Title IX Required Reporting and Confidential Resource Policy

1. REQUIRED REPORTERS

This Policy applies to all staff, faculty and Residential Assistants except for those individuals explicitly designated as Confidential Employees in Section 2. This Policy is limited to issues involving sex and gender (Title IX)

We take seriously our obligation to take reasonable steps to identify and prevent incidents of sex discrimination. Employees at all levels play a role in our efforts to do so.

Upon learning information that may implicate Title IX, any staff, faculty or RA who is not a Confidential Employee must promptly share all known details to a member of the Title IX Compliance Team. Communicating information to the Title IX Team under this policy is not tantamount to making an accusation. Instead, this information-sharing allows the Title IX Coordinator to deploy resources and information to a potential Complainant and, if needed, protect campus safety. 

These reporting requirements increase the likelihood that individuals will receive access to supportive measures, ensure that all College community members have equitable access to the resolution processes, and allow the College to take appropriate action consistent with its Title IX obligations and educational mission while still respecting individual agency and autonomy.

Information disclosed to a Compliance Team member will be provided to the Title IX Coordinator. 

If the College discovers that a non-Confidential staff, faculty or RA was aware of information that they knew or should have known implicated Title IX, and failed to inform the Title IX Office of that information, the employee may be subject to disciplinary action.

Complainants may want to carefully consider whether they share personally identifiable details with Required Reporters, as those details must be shared with the Title IX Coordinator.

 

2. ON-CAMPUS CONFIDENTIAL RESOURCES

Complainants may confidentially access support and resources through specific employees who have been designated as Confidential Resources. Those designated by the College as Confidential Resources are not required to report actual or suspected Title IX violations in a way that identifies any individual involved, including the person making the report or any individual involved in the report.  Confidential Resources will maintain confidentiality except in extreme cases of immediacy of threat or danger or abuse of a minor, elder, or individual with a disability, or when required to disclose by law or court order. 

Confidential Resources will provide the reporting party with the Title IX Coordinator’s contact information and offer options and resources. Confidential Employees are prohibited from sharing identifying information with the College or an outside agency unless a Complainant has requested in writing that the information be shared.

If a Complainant would like the details of an incident to be kept confidential, the Complainant may speak with the Nicole Kipphut, Director of Violence Prevention at The Harbor and the College’s Confidential Resource Advisor.1

Campus Ministry employees will maintain confidentiality of information they receive in the course of their duties in Campus Ministry.

Upon notice of potential harassment or discrimination, Confidential Resources will timely submit anonymous statistical information for Clery Act purposes unless she believes it would be harmful to their client, patient, or parishioner.
